JUDICIAL NOMINATING COMMISSION MEMBER

PROCEDURE FOR FILING DISCLOSURE

SUMMARY:

Pursuant to s. 112.312(7)(b), as amended by Ch. 74- 177, Laws of Florida, and an earlier commission opinion, CEO 74-11, a member of a judicial nominating commission is a public officer and therefore is subject to disclosure provisions relating to public officers. As such commissions are state bodies, their members are to file statements of disclosure with the Department of State, The Capitol.

QUESTION:

Is a member of the Seventh Circuit Judicial Nominating Commission a public officer within the definition of that term as found in part III, Ch. 112, F. S., as amended by Ch. 74-177, Laws of Florida, and therefore subject to the disclosure provisions as applied to public officers?

Please find enclosed a copy of a previous opinion of this commission, CEO 74-11, which answers your inquiry. Also enclosed are the necessary forms for complying with the disclosure law.

In addition, it should be noted that the Seventh Circuit Judicial Nominating Commission is regarded as a state agency, thus making you a state officer. You should therefore file your disclosure statement(s) with the Department of State. See s. 112.313(3), F. S.
